Welcome to Wolves Den.

In these Terms of Service, the terms “Wolves Den,” “we,” “us” and “our” refer to the operator of the Wolves Den online store and website.

Wolves Den provides this website, including its information, content, features, products, tools and related services, to give customers access to a curated premium apparel and lifestyle shopping experience. Our online store is hosted and powered by Shopify.

These Terms of Service, together with the policies referred to within them, explain the conditions that apply when you access our website, create an account, communicate with us or purchase our products.

By accessing or using our website, placing an order or otherwise using our services, you agree to these Terms of Service and our:

Privacy Policy
Shipping Policy
Returns and Refund Policy
Any other policies or terms displayed on our website

If you do not agree to these Terms, you must not use our website or services.

Nothing in these Terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other applicable New Zealand law.

1. Eligibility and Accounts

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our website.

When using our website or placing an order, you agree to provide information that is accurate, complete and current.

You are responsible for:

Maintaining the confidentiality of your account details and password
Restricting access to your account and devices
Ensuring that your contact, billing and delivery information is correct
All activity carried out through your account

You must notify us promptly if you believe your account has been accessed or used without your permission.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms.

2. Our Products

We make reasonable efforts to ensure that our product descriptions, photographs, measurements, colours and other information are accurate.

However:

Colours may appear differently depending on your screen, device and display settings.
Product measurements may vary slightly due to the way garments are measured.
Minor variations in colour, fabric texture, washing, embroidery, stitching or print placement may occur between production batches.
Natural creasing, texture and finishing characteristics may vary between individual garments.

These reasonable variations are not necessarily product faults.

Product images are provided for illustrative purposes. Unless otherwise stated, accessories, styling items, packaging or props shown in an image are not included with the product.

We may update product descriptions, specifications, colours, sizing, materials or availability where reasonably necessary. Changes will not affect orders that we have already accepted unless we contact you and obtain your agreement.

We may discontinue products or restrict quantities available for purchase at any time.

3. Sizing and Product Selection

Customers are responsible for reviewing the product description, measurements and applicable size guide before placing an order.

Sizing may vary between different Wolves Den products and collections. A particular size in one design may not fit exactly the same as that size in another design.

Any sizing guidance we provide is general information and does not guarantee a particular fit.

Where you select the wrong size, any return or exchange will be handled in accordance with our Returns and Refund Policy.

4. Orders

When you submit an order, you are making an offer to purchase the selected products under these Terms.

An automated order confirmation confirms that we have received your order. It does not necessarily mean that your order has been accepted.

Your order is accepted when:

We confirm that the order has been processed or dispatched; or
We otherwise expressly confirm acceptance.

We may decline or cancel an order before acceptance where reasonably necessary, including where:

A product is unavailable
Incorrect product or pricing information was displayed
Payment cannot be authorised
We reasonably suspect fraud, misuse or unauthorised resale
Delivery is not available to the address provided
An order exceeds any stated purchase limit
A technical or inventory error has occurred

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product using the original payment method.

Please review your order carefully before submitting it. Once an order has entered processing or fulfilment, we may not be able to change or cancel it.

5. Product Availability and Limited Releases

Some Wolves Den products may be produced in limited quantities or released as part of limited collections or product drops.

Adding a product to your cart does not reserve the product. A product is not secured until checkout has been completed, payment has been successfully processed and the order has been accepted.

Products may sell out while they are in your cart or while payment is being processed.

We do not guarantee that discontinued or sold-out products will be restocked.

We may limit the number of products that may be purchased by one customer, household, account, payment method or delivery address.

6. Pre-Orders

Products offered on a pre-order basis will be clearly identified on the relevant product page.

Estimated production and dispatch dates are estimates only and may change due to manufacturing, freight, customs, quality-control or other circumstances beyond our reasonable control.

Where a significant pre-order delay occurs, we will provide an update using the contact details supplied with your order.

If we are unable to fulfil a pre-order, we will provide a refund using the original payment method.

Any cancellation rights for pre-orders will be explained on the applicable product page and remain subject to your rights under New Zealand law.

Unless otherwise stated, products purchased together with a pre-order item may be dispatched in one shipment once all products are available.

7. Personal Use and Resale

Our products are supplied primarily for personal and household use.

You must not purchase Wolves Den products for unauthorised commercial resale, redistribution, replication or export without our prior written approval.

We may cancel or restrict orders where we reasonably believe products are being purchased for:

Unauthorised resale
Counterfeiting
Commercial copying
Fraudulent activity
Circumventing product purchase limits

Nothing in this section restricts any lawful resale rights that cannot legally be excluded.

8. Prices and Currency

Unless stated otherwise, prices displayed on our New Zealand website are in New Zealand dollars (NZD) and include Goods and Services Tax where applicable.

Shipping costs and any other applicable charges will be displayed during checkout before you complete your purchase.

For international orders, you may be responsible for customs duties, import taxes, brokerage charges or other fees imposed by the destination country. These charges are not controlled by Wolves Den and are not included unless expressly stated.

Prices may change without notice. The price charged will be the price displayed when your order is submitted, subject to correction of genuine errors.

9. Pricing and Website Errors

We aim to ensure that all product, price, promotion and availability information is accurate. However, errors may occasionally occur.

If a product has been listed at an obviously incorrect price or with materially incorrect information, we may contact you before accepting the order.

You may choose to proceed with the corrected information or cancel the affected item.

If your order has already been charged and is cancelled because of a genuine error, we will issue a refund using the original payment method.

Nothing in this section permits Wolves Den to engage in misleading or deceptive conduct or limits your rights under the Fair Trading Act 1986.

10. Payments

Payment must be made using one of the payment methods available at checkout.

By submitting payment information, you confirm that:

You are authorised to use the selected payment method
The information provided is accurate and complete
Sufficient funds or credit are available to complete the transaction
You authorise the applicable payment provider to process the transaction

Payments are processed by Shopify and other third-party payment providers. Wolves Den does not ordinarily receive or store your complete payment card details.

Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy.

11. Promotions and Discount Codes

Discount codes, promotional offers and competitions may be subject to separate conditions.

Unless otherwise stated:

Discount codes cannot be exchanged for cash
Only one discount code may be used per order
Discount codes cannot be applied retrospectively
Discount codes may exclude selected products, collections, pre-orders, collaborations, sale items or gift cards
Promotions are available only during the stated promotional period
Promotional offers are subject to product availability

We may cancel, amend or suspend a promotion where reasonably necessary because of an error, fraud, misuse or circumstances outside our control.

This does not limit any rights you may have under applicable consumer law.

12. Gift Cards and Store Credit

Gift cards and store credits may only be used through the Wolves Den store and cannot be exchanged for cash except where required by law.

Gift cards should be treated like cash. We are not responsible for a gift card that is lost, stolen, deleted or used without permission, except where the loss results from an act or omission by Wolves Den.

Any expiry date or additional conditions will be displayed when the gift card or store credit is issued.

Refunds relating to purchases made using a gift card may be returned to the original gift card or issued as store credit, subject to applicable law.

13. Shipping and Delivery

Shipping options, estimated delivery timeframes and applicable charges are displayed at checkout or in our Shipping Policy.

Delivery timeframes are estimates and may be affected by:

Courier delays
Customs processing
Severe weather
Public holidays
Peak sales periods
Incorrect delivery details
Events outside our reasonable control

Where Wolves Den arranges delivery, we remain responsible for the order until it is delivered in accordance with applicable New Zealand consumer law.

If your order is lost, damaged, significantly delayed or delivered incorrectly, please contact us so that we can investigate the matter with the delivery provider.

You must provide a complete and accurate delivery address. We are not responsible for delays or additional costs resulting from incorrect or incomplete information supplied by you, although we will take reasonable steps to assist.

Where a delivery is returned to us because it was unclaimed, refused or addressed incorrectly, additional shipping charges may apply before the order is resent.

14. International Orders

International customers are responsible for checking whether the products they order can lawfully be imported into their destination country.

International deliveries may be subject to:

Customs inspection
Import duties
Taxes
Brokerage fees
Local delivery charges

Unless stated otherwise, these costs are the responsibility of the customer.

We are not responsible for customs delays or for goods lawfully held by a government or border authority due to local import requirements.

If an international order is returned because it was refused, unclaimed or customs charges were not paid, any refund will be processed in accordance with our Returns and Refund Policy and may be reduced by shipping and return costs actually incurred, to the extent permitted by law.

15. Returns, Exchanges and Refunds

Returns, exchanges and refunds are managed under our Returns and Refund Policy.

That policy forms part of these Terms.

Nothing in these Terms or our Returns and Refund Policy limits your rights under the Consumer Guarantees Act 1993.

Where a product does not meet a guarantee required by New Zealand law, you may be entitled to an appropriate remedy, which may include repair, replacement, refund or compensation depending on the circumstances and seriousness of the failure.

Change-of-mind returns are not required by law and are available only under the conditions stated in our Returns and Refund Policy.

16. Consumer Guarantees

Products supplied by Wolves Den to New Zealand consumers come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993.

These include guarantees that products will, where applicable:

Be of acceptable quality
Be fit for their usual purpose
Match their description
Match any sample or demonstration model
Be reasonably fit for a particular purpose made known to us and accepted by us
Arrive within an agreed or reasonable time where we arrange delivery

Nothing in these Terms is intended to exclude, restrict or modify a legal right or remedy where doing so would be unlawful.

17. Care Instructions

Customers are responsible for following the care instructions provided on the garment label, product page or packaging.

Damage caused by misuse, accidental damage, ordinary wear and tear, incorrect washing, bleaching, excessive heat, improper drying, alteration or failure to follow care instructions may not constitute a manufacturing fault.

This does not limit your rights where a product was not of acceptable quality or the care instructions supplied were inadequate or incorrect.

18. Intellectual Property

Unless otherwise stated, all material appearing through the Wolves Den website and services is owned by or licensed to Wolves Den.

This includes:

The Wolves Den name and branding
The WD monogram
Wolf and claw designs
Logos, badges and symbols
Product names and collection names
Slogans and brand statements
Garment designs and artwork
Photographs, graphics and videos
Website layouts and written content
Marketing material and packaging designs

This material is protected by applicable copyright, trademark and other intellectual property laws.

You may access and use our website for personal, non-commercial shopping purposes only.

Without our prior written permission, you must not:

Reproduce, copy or distribute our content
Use our logos, artwork or garment designs
Create products derived from our designs
Modify or commercially exploit our content
Scrape or systematically extract website content
Use our content to train or develop artificial intelligence systems
Represent yourself as being associated with Wolves Den
Manufacture, advertise or sell counterfeit Wolves Den products

No licence or ownership right is granted to you except for the limited right to use the website in accordance with these Terms.

“Wolves Den,” the WD monogram, Wolves Den logos, associated designs, product names and slogans are proprietary to Wolves Den and must not be used without prior written permission.

19. Reviews, Photographs and Customer Content

You may be able to submit reviews, photographs, comments, suggestions or other content through our website or social media channels.

You remain the owner of content you create. By submitting content directly to Wolves Den, tagging Wolves Den, or giving us permission to repost it, you grant Wolves Den a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish and share that content for our website, social media, advertising and promotional activities.

Where reasonably practicable, we may identify or tag the original creator.

You confirm that:

You created the content or have permission to submit it
The content is accurate and not misleading
The content does not infringe another person’s rights
Anyone identifiable in the content has consented to its submission and permitted use
The content is not unlawful, abusive, defamatory or obscene

We may moderate or remove customer content where reasonably necessary, including where it breaches these Terms.

We are not required to publish every review or submission. However, we will not manipulate customer reviews in a way that is misleading or deceptive.

20. Third-Party Tools and Services

Our website may provide access to services supplied by third parties, including payment providers, courier tracking services, review platforms and social media integrations.

Third-party services may have their own terms and privacy policies. Your use of those services is at your discretion and may be subject to those separate terms.

To the extent permitted by law, Wolves Den is not responsible for the operation or content of third-party services that we do not control.

Nothing in this section excludes responsibility that Wolves Den cannot lawfully exclude.

22. Relationship With Shopify

Wolves Den’s online store is hosted and powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

Purchases made through the Wolves Den store are transactions directly between you and Wolves Den.

Shopify is not the seller of Wolves Den products and is not responsible for fulfilling Wolves Den orders or providing remedies relating to products sold by Wolves Den.

Shopify may collect and process information relating to your access to and use of our store in accordance with its own terms and privacy practices.

23. Privacy

Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy.

By using the website, you acknowledge that personal information may also be processed by Shopify and other service providers that help us operate the store, process payments, prevent fraud, fulfil orders and provide customer support.

24. Acceptable Use

You must use our website and services only for lawful purposes.

You must not:

Use the website for fraudulent or unlawful activity

To the fullest extent permitted by law, we do not guarantee that:

Every product will remain available
Website content will be free from minor typographical or technical errors
Your device will display every colour or product detail identically

27. Limitation of Liability

To the fullest extent permitted by law, Wolves Den will not be liable for indirect, incidental or consequential loss arising from your use of the website or purchase of a product where that loss was not reasonably foreseeable.

Nothing in these Terms excludes or limits liability:

Under the Consumer Guarantees Act 1993 where that Act applies
For misleading or deceptive conduct
For fraud or wilful misconduct
For death or personal injury caused by negligence
Where liability cannot lawfully be excluded or limited

Where you acquire products from Wolves Den for business purposes and the Consumer Guarantees Act does not apply or has been validly contracted out of in writing, our liability will be limited to the extent permitted by law.

28. Indemnity

To the extent permitted by law, you agree to compensate Wolves Den for reasonable losses, claims or costs arising directly from:

Your unlawful use of the website
Your material breach of these Terms
Your infringement of another person’s intellectual property or legal rights
Content you submit without the necessary authority

This section does not require you to compensate Wolves Den for losses caused by Wolves Den’s own negligence, unlawful conduct or breach of these Terms.

29. Suspension and Termination

We may suspend or terminate your access to our website or account where we reasonably believe that you have:

Used the website fraudulently or unlawfully
Threatened the security or operation of the website

Changes will not apply retrospectively to an order already accepted unless required by law or agreed with you.

The remaining provisions will continue to apply.

32. No Waiver

If Wolves Den does not immediately enforce a right under these Terms, this does not mean that we have waived that right.

A waiver will be effective only where it is expressly confirmed in writing.

33. Entire Agreement

These Terms and the policies referred to in them form the agreement between you and Wolves Den regarding your use of our website and purchases from our online store.

They replace any previous version of our website terms relating to the same matters.

34. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights and obligations as part of a genuine sale, restructure or transfer of the Wolves Den business, provided this does not reduce your existing consumer rights.

35. Governing Law

These Terms are governed by the laws of New Zealand.

You and Wolves Den submit to the non-exclusive jurisdiction of the New Zealand courts.

If you are purchasing from outside New Zealand, you may also have mandatory consumer rights under the laws of the country in which you reside. Nothing in these Terms excludes rights that cannot legally be excluded.
